The above named appellant having appealed to this court from a JUDGMENT of the CIVIL COURT, CITY OF NEW YORK, QUEENS COUNTY entered on JANUARY 5, 2006, and the APPELLANT having moved this court by notice of motion returnable JUNE 18, 2007 for PERMISSION TO APPEAL ON AN ABRIDGE RECORD AND TO CONTINUE THE STAY CONTAINED IN THE ORDER OF THIS COURT DATED JUNE 19, 2006 and said motion having duly come on to be heard;

Now, on reading the papers filed in support of said motion and no papers having been filed in opposition thereto, and due deliberation having been had thereon, it is,

ORDERED that the branch of the motion seeking leave to proceed upon an abridged record is denied; and it is further,

ORDERED that the branch of the motion seeking to continue stay pending determination of appeal is granted on condition that appellant perfects the appeal by October 5, 2007. The stay contained in the order of this court, entered June 19, 2006, is continued on condition that appellant perfects the appeal by October 5, 2007 as above indicated. Appellant shall continue to comply with all the other conditions contained in the orders of this court dated March 28, 2006 and June 19, 2006. In the event that any of the above conditions are not met, the court, on its own motion, may vacate the stay, or landlord-respondent may move to vacate the stay on three days' notice.; and it is further,

ORDERED that on the court's own motion, time to perfect appeal is enlarged to October 5, 2007.
