| DECISION & ORDER ON MOTION |
On the court's own motion, it is
ORDERED that its decision and order on motion dated March 29, 2007, in the above-entitled case is amended by deleting the second decretal paragraph thereof and substituting therefor the following:
"ORDERED that the branch of the motion which is to strike the appendix as inadequate is granted to the extent that on or before May 4, 2007, the appellant shall serve and file a supplemental or replacement appendix containing relevant portions of the transcript in accordance with the CPLR and the rules of the court (see CPLR 5528; 22 NYCRR 10.2[c][1][v])."
