It is Ordered that the motion to enlarge the time to perfect the appeal from a judgment after a trail that took place on October 12, 2004, is denied. [ see 22 NYCRR § 640.6 ] By order of this Court, dated July 13, 2007, the appeal was dismissed for failure to diligently prosecute and for failing to comply with the March 26, 2007 order of this Court.
