It is Ordered that the motion is granted. The dismissal order of this court, previously granted on default, is hereby vacated. The appellant's time to perfect the appeal is extended until September 11, 2007, in order for the appeal to be noticed for the November 2007 term. In the event of appellant's failure to comply with the foregoing condition, the respondent may move on five days' notice for an order dismissing the appeal and releasing the funds on deposit to the plaintiff herein. No further extension of time to perfect will be granted in this two year old appeal ( see 22 NYCRR- § 640.6 ).
