| DECISION & ORDER ON APPLICATION |
Application by the respondents Gerald Antonacci and David Antonacci pursuant to 22 NYCRR 670.8(d)(2) to enlarge the time to serve and file a brief on an appeal from an order of the Supreme Court, Nassau County, entered June 19, 2006.
ORDERED that on the court's own motion, the appeal in the above-entitled action and the application for an enlargement of time are transferred to the Appellate Division, First Department, pursuant to New York Constitution, article VI, § 4(i), for hearing and determination; and it is further,
ORDERED that all further proceedings in connection with this appeal shall be conducted pursuant to the rules of the Appellate Division, First Department.
