DECISION & ORDER ON MOTION

Motion by the appellant pro se to relieve counsel assigned to prosecute an appeal from a judgment of the County Court, Nassau County, rendered September 9, 2005, and for the assignment of new counsel.

Upon the papers filed in support of the motion and the papers filed in relation thereto, it is

ORDERED that the motion is denied, without prejudice to the appellant seeking leave to file a supplemental pro se brief once the appeal is perfected; and it is further,

ORDERED that assigned counsel is directed to perfect the appeal on or before September 4, 2007.
