DECISION & ORDER ON MOTION

Motion by the appellant pro se to relieve counsel assigned to prosecute an appeal from a judgment of the Supreme Court, Queens County, rendered July 27, 2005, and to assign new counsel.

Upon the papers filed in support of the motion and the papers filed in opposition and relation thereto, it is

ORDERED that the motion is denied without prejudice to seeking leave to file a supplemental pro se brief when the appeal is perfected; and it is further,

ORDERED that on or before August 31, 2007, assigned counsel shall perfect the appeal.
