| DECISION & ORDER ON MOTION |
Motion by Kent V. Moston, Esq., counsel assigned to represent the appellant in a proceeding before the Family Court, Nassau County, to be relieved on an appeal from an order of the Family Court, Nassau County, dated January 19, 2007. By order to show cause dated June 27, 2007, the parties or their attorneys were directed to show cause before this court why an order should or should not be made and entered dismissing the appeal in the above-entitled proceeding as abandoned, and the motion by assigned counsel was held in abeyance in the interim.
Upon the papers filed in support of the motion and no papers having been filed in opposition or relation thereto, and upon the order to show cause and no papers having been filed in response thereto, it is
ORDERED that the order to show cause to dismiss the appeal is granted and the appeal is dismissed, without costs or disbursements; and it is further,
ORDERED that the motion by assigned counsel is granted.
