(Docket No. V-6205-05)

DECISION & ORDER ON MOTION

Appeal by the Law Guardian from an order of the Family Court, Westchester County, dated April 27, 2007. The court has received a copy of a letter dated June 15, 2007, from the 14 year-old subject child to the effect that he does not want the appeal to proceed. By order to show cause dated June 29, 2007, the parties or their attorneys were directed to show cause before this court why an order should or should not be made and entered dismissing the appeal in the above-entitled proceeding as withdrawn.

Upon the order to show cause and the papers filed in response thereto, it is

ORDERED that the order to show cause to dismiss the appeal is held in abeyance and referred to the panel of Justices hearing the appeal for determination upon the argument or submission thereof.

RIVERA, J.P., SPOLZINO, COVELLO and McCARTHY, JJ., concur.
