Motion by the appellant to clarify or resettle a decision and order on motion of this court dated June 13, 2007, which determined the respondent's motion to recall and vacate a decision and order of this court dated April 17, 2007, which determined an appeal from an order of the Supreme Court, Kings County, dated October 3, 2005.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
