ORDERED that its decision and order on motion dated July 31, 2007, in the above-entitled matter is recalled and vacated, and the following decision and order on motion is substituted therefor:
Motion by Rosemary Toriola for leave to appeal to this court from an order of the Appellate Term of the Supreme Court, Second and Eleventh Judicial Districts, dated December 15, 2006, which determined an appeal and cross appeal from an order of the Civil Court, City of New York, Queens County, entered March 7, 2005, appeals from two orders of the same court both entered February 7, 2005, and appeals from two orders of the same court entered March 3, 2005, and April 5, 2005, respectively.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that the motion is denied.
