Nwankwo, Cordelia v Highbridge Community HDFC
It is Ordered that the motion to dismiss is granted unless the appellant perfects the appeal for the November 2007 term of this court. The filing deadline is September 11, 2007. No further extension of time will will be granted in this appeal from a judgment entered over seventeen (17) months ago and where a conditional dismissal order of this court, requiring the prompt perfection of the appeal by April 10, 2007, has not been followed. [ see 22 NYCRR § 640.6 ] In the event of appellant's failure to perfect the appeal for the November 2007 term, the plaintiff-respondent may move on five days' notice for an order dismissing the appeal and releasing the funds on deposit to the respondent.
