It is Ordered that the motion to dismiss the petitioner's appeals is granted unless the appeals are perfected by the December 2007 term of this court. The filing deadline is October 10, 2007. The cross-motion is granted only to the extent of dismissing the respondent's cross-appeal for failure to diligently prosecute unless the respondent's cross-appeal is also perfected by October 10, 2007 and noticed for the December term. In all other respects, the cross-motion is denied. The parties should attempt to prepare joint records for the appeals, if possible.
