Appeal and cross appeal from an order of the Supreme Court, Orange County, dated March 2, 2006. On the court's own motion, the appeal was dismissed by decision and order on motion dated February 2, 2007, entitled "In the Matter of Dismissal of Causes for Failure to Perfect- January 2007 Calendar."
Now, on the court's own motion, it is
ORDERED that so much of the decision and order on motion of this court dated February 2, 2007, entitled "In the Matter of Dismissal of Causes for Failure to Perfect- January 2007 Calendar," as dismissed the above-entitled appeal is recalled and vacated and the appeal is reinstated.
