It is Ordered that the motion for a stay of the execution of the warrant of eviction and the attorney's fee hearing is granted on condition that the appellant: 1 - perfects the appeal for the December 2007 term of the court, the filing deadline is October 10, 2007; and 2 - continues paying monthly use and occupancy as previously paid, without prejudice. In the event the appellant fails to comply with either of the foregoing conditions, the petitioner may move on five days' notice for an order vacating the stay.
