DECISION & ORDER ON APPLICATION

Application by the defendant (1) on appeal from an execution of sentence of the Supreme Court, Kings County, imposed September 20, 2004, which was dismissed by decision and order on motion of this court dated June 28, 2005, and (2) on a motion for leave to file a late notice of appeal from a judgment of the Supreme Court, Kings County, rendered November 5, 2003, which was denied by decision and order on motion of this court dated June 28, 2005, for a writ of coram nobis to vacate the decision and order on motion of this court dated June 28, 2005, on the ground of, inter alia, ineffective assistance of appellate counsel.

Upon the papers filed in support of the application and the papers filed in opposition thereto, it is

ORDERED that the application is denied.
