| DECISION & ORDER ON MOTION |
Motion by the respondents-appellants on an appeal and cross appeal from an order of the Supreme Court, Nassau County, entered June 13, 2006, to enlarge the time to serve and file their answering brief, including their points of argument on the cross appeal. Cross motion by the appellants-respondents, inter alia, to dismiss the cross appeal for failure to timely serve and file the answering brief.
Upon the papers filed in support of the motion and the cross motion, and the papers filed in opposition thereto, it is
ORDERED that the motion is granted, the respondents-appellants' time to serve and file their answering brief, including their points of argument on the cross appeal (see 22 NYCRR 670.8[c][3]), is enlarged until September 26, 2007, and the respondents-appellants' brief must be served and filed on or before that date; and it is further,
ORDERED that the cross motion is denied.
