| DECISION & ORDER ON MOTION |
Motion by the defendant pursuant to CPL 460.30 for an extension of time to take an appeal from a judgment of the Supreme Court, Queens County, rendered June 14, 2006, under Indictment No. 3345/99 (Appellate Division Docket No. 2007-06462), in effect, to amend a decision and order on motion of this court dated September 26, 2006, which granted the appellant leave to prosecute an appeal from a separate judgment of the same court rendered April 24, 2006, under Indictment No. 3345/99 (Appellate Division Docket No. 2006-04588), as a poor person, and assigned counsel to prosecute that appeal, to also grant leave to prosecute the appeal from the other judgment as a poor person and assign counsel to prosecute that appeal, and to consolidate the appeals.
Upon the papers filed in support of the motion and no papers having been filed in opposition or relation thereto, it is
ORDERED that the branches of the motion which are for an extension of time to take an appeal from the judgment rendered June 14, 2006, and, in effect, to amend the decision and order on motion of this court dated September 26, 2006, are granted; and it is further,
ORDERED that the defendant's moving papers are deemed to constitute a timely notice of appeal from the judgment rendered June 14, 2006; and it is further,
ORDERED that the decision and order on motion of this court dated September 26, 2006, is amended, the appellant is granted leave to prosecute the appeal from the judgment rendered June 14, 2006, as a poor person and counsel assigned to prosecute the appeal from the judgment rendered April 24, 2006, is also assigned to prosecute the appeal from the judgment rendered June 14, 2006; and it is further,
ORDERED that the appellant's assigned counsel is directed to serve a copy of this order upon the Clerk of the court from which the appeal is taken; and it is further,
ORDERED that the branch of the motion which is to consolidate the appeals is denied as unnecessary.
