DECISION & ORDER ON MOTION

Motion by the appellant's assigned counsel to relieve counsel assigned to prosecute an appeal from an order of the County Court, Nassau County, dated June 22, 2006, and for the assignment of new counsel.

Upon the papers filed in support of the motion and no papers having been filed in opposition or relation thereto, it is

ORDERED that the motion is denied without prejudice to the appellant pro se seeking leave to serve and file a supplemental brief when the appeal is perfected; and it is further,

ORDERED that the appellant shall perfect the appeal on or before October 29, 2007.
