| DECISION & ORDER ON MOTION |
Motion by Howard Silver, inter alia, for leave to appeal to this court from an order of the Supreme Court, Suffolk County, dated July 24, 2007 (Appellate Division Docket No. 2007-07595), and to stay the sale of the subject premises pending hearing and determination of an appeal and cross appeal from an order of the same court dated May 4, 2007 (Appellate Division Docket No. 2007-04964).
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that the branch of the motion which is for leave to appeal to this court from the order dated July 24, 2007, is denied; and it is further,
ORDERED that the motion is otherwise is denied.
