It is Ordered that the motion to dismiss is granted unless the appeal is perfected by the December 2007 term. The filing deadline is October 10, 2007. In the event of appellant's failure to comply with the foregoing condition, the respondent may move on five days' notice for an order dismissing the appeal. In all other respects, the motion is denied. The court notes that the appeal is from a judgment, dated November 22, 2006, in a nuisance holdover proceeding and it has yet to be perfected, despite numerous orders of this court and in violation of 22 NYCRR § 640.6.
