DECISION & ORDER ON MOTION

Motion by the petitioner for leave to appeal to this court from an order of the Family Court, Kings County, dated August 16, 2007, to stay enforcement of the order dated August 16, 2007, pending hearing and determination of the appeal, and for leave to prosecute the appeal as a poor person. Application by the respondent to enlarge the time to file opposition to the motion.

Upon the papers filed in support of the motion and the papers filed in opposition thereto, and upon the application, it is

ORDERED that the branch of the motion which is for leave to appeal is denied; and it is further,

ORDERED that the motion is otherwise denied as academic; and it is further,

ORDERED that the application is denied.
