| DECISION & ORDER ON MOTION |
Motion by the appellant on appeals from a judgment of the Supreme Court, Queens County, rendered June 30, 2003, an amended sentence of the same court rendered August 12, 2003, and an amended sentence of the same court imposed October 19, 2005, to strike the respondent's brief on the ground that it was not timely served and filed, and to enlarge his time to serve and file a reply brief.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that the branch of the motion which is to strike the respondent's brief is denied; and it is further,
ORDERED that the branch of the motion which is to enlarge the time to serve and file a reply brief is granted and the reply brief submitted to the Clerk of this court is accepted for filing.
