It is Ordered that the motion for an order vacating the stay of the execution of the warrant of eviction is granted unless appellant: 1- pays outstanding rental arrears, on or before September 20, 2007, without prejudice; 2- continues paying petitioner-landlord monthly use and occupancy, without prejudice; and 3- perfects the appeal for the December 2007 term of this court - the filing deadline is October 10, 2007. In the event of appellant's failure to comply with the foregoing conditions, the petitioner may move on five days' notice for an order vacating the stay.
