ORDER ON APPLICATION

Application by the Northeast Land Development Corporation pursuant to 22 NYCRR 670.8(d)(2) to enlarge the time to serve and file briefs on appeals and cross appeals from an order of the Supreme Court, Nassau County, dated May 5, 2006 (Appellate Division Docket No. 2006-05693), and a judgment of the same court dated May 19, 2006 (Appellate Division Docket No. 2006-05694), and appeals and a cross appeal from an order of the same court dated May 10, 2007 (Appellate Division Docket No. 2007-04626).

ORDERED that the application is granted; and it is further,

ORDERED that Northeast Land Development Corporation shall serve and file a respondent's brief to the brief filed by the cross appellants in connection with the appeals pending under Appellate Division Docket Nos. 2006-05693 and 2006-05694 on or before September 17, 2007; the respondents-appellants may serve and file a reply brief to the brief of Northeast Land Development Corporation on or before October 2, 2007; and it is further,

ORDERED that on the appeals and cross appeals pending under Appellate Division Docket No. 2007-04626, the appellants-respondents shall perfect their respective appeals on or before September 17, 2007; the plaintiffs-appellants-respondents shall serve and file a brief responding to the appeals of the defendants-appellants-respondents on or before October 22, 2007; the respondent-appellant, Fidelity & Deposit Co. of Maryland, shall serve and file its answering brief to the brief of the plaintiffs-appellants-respondents, including its points of argument on its cross appeal (see 22 NYCRR 670.8[c][3]), on or before October 22, 2007; the defendants-appellants-respondents shall file reply briefs to the answering brief of the plaintiffs-appellants-respondents on or before November 7, 2007; the plaintiffs-appellants-respondents shall file their brief responding to the cross appeal of Fidelity & Deposit Co. of Maryland and in reply on their own appeal on or before December 12, 2007; and Fidelity & Deposit Co. of Maryland shall serve and file its reply brief on or before December 31, 2007.
