Motion by counsel assigned to prosecute an appeal from a purported resentence of the Supreme Court, Kings County, imposed May 19, 2005, pursuant to chapter 738 of the Laws of 2004, for leave to withdraw the appeal on the ground that it has been rendered academic by a resentence of the same court imposed May 23, 2007 (Appellate Division Docket No. 2007-05886).
Upon the papers filed in support of the motion and the papers filed in relation thereto, it is
ORDERED that the motion is granted and the appeal is deemed withdrawn.
