DECISION & ORDER ON MOTION

Motion by counsel assigned to prosecute an appeal from an order of the Family Court, Suffolk County, dated August 11, 2006, to be relieved on the ground that the appellant has abandoned the appeal.

Upon the papers filed in support of the motion and the papers filed in relation thereto, it is

ORDERED that on the court's own motion, the appeal is dismissed, without costs or disbursements, as abandoned; and it is further,

ORDERED that the motion is granted.
