DECISION & ORDER ON MOTION

Motion by the respondent to dismiss the appellant's motion to reduce, as excessive, two sentences of the Supreme Court, Orange County, imposed March 6, 2006, for failure to provide the transcript of the proceedings which occurred on January 12, 2006.

Upon the papers filed in support of the motion and no papers having been filed in opposition or relation thereto, it is

ORDERED that the motion to dismiss is denied on condition that on or before November 5, 2007, the appellant provide the respondent with the transcript of the proceedings which occurred on January 12, 2006 (see 22 NYCRR 690.12[c][2]).
