DECISION & ORDER ON MOTION

Appeal by the defendant from a judgment of the Supreme Court, Queens County, rendered March 23, 2000. By decision and order on motion dated April 19, 2007, the appellant's motion, in effect, pursuant to CPL 460.30 to extend his time to take an appeal from the judgment was granted and the court directed the appellant to either (1) perfect the appeal, (2) advise the court of the name of his attorney, or (3) move for leave to prosecute the appeal as a poor person and for the assignment of counsel, on or before June 18, 2007. The appellant has not complied with the decision and order on motion of this court. By order to show cause dated July 19, 2007, the appellant was directed to show cause before this court why this appeal should or should not be dismissed on the ground that he abandoned the appeal by failing to comply with the decision and order on motion dated April 19, 2007.

Upon the order to show cause and the papers filed in response thereto, it is

ORDERED that the motion to dismiss the appeal is denied; and it is further,

ORDERED that retained counsel shall prosecute the appeal expeditiously in accordance with this court's rules (see 22 NYCRR 670.1, et seq.) and written directions.
