| DECISION & ORDER ON MOTION |
Motion by the respondent to dismiss an appeal from a judgment of the Supreme Court, Orange County, dated July 26, 2006, on the ground that the appellant failed to comply with the decision and order on motion of this court dated July 24, 2007.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that the motion is granted to the extent that on or before October 3, 2007, the respondent shall provide the appellant with copies of the respondent's trial exhibits and on or before October 24, 2007, the appellant shall serve and file a supplemental record containing those exhibits; and it is further,
ORDERED that the respondent's time to serve and file a brief is enlarged until November 26, 2007, and the respondent's brief must be served and filed on or before that date.
