DECISION & ORDER ON APPLICATION

Application by the appellant on an appeal from an order of the Supreme Court, Richmond County, dated July 26, 2007, to amend a prior decision and order on motion of this court dated August 16, 2007, in the above-entitled action by deleting the provisions thereof granting those branches of her motion which were for an expedited briefing schedule and a preference in the calendaring of the appeal, and substituting therefor a provision denying those branches of the motion.

Upon the papers filed in support of the application and no papers having been filed in opposition or relation thereto, it is

ORDERED that the application is granted, and the decision and order on motion of this court dated August 16, 2007, in the above-entitled action is amended by deleting the second and third decretal paragraphs thereof, and substituting therefor the following decretal paragraphs:

"ORDERED that those branches of the motion which were for an expedited briefing schedule and a preference in the calendaring of the appeal are denied; and it is further,

ORDERED that the appeal is referred to the Clerk of this court for the issuance of a scheduling order pursuant to § 670.4(a) of the rules of this court (see 22 NYCRR 670.4[a])."
