DECISION & ORDER ON MOTION

Motion by the respondent for reinstatement as an attorney and counselor-at-law. The respondent was admitted to the Bar at a term of the Appellate Division of the Supreme Court in the First Judicial Department on February 25, 1974. By opinion and order of this court dated September 8, 1994, the respondent was suspended from the practice of law for a period of three years, effective immediately (see Matter of McKeon, 202 AD2d 57). By opinion and order of this court dated May 22, 1995, the respondent was disbarred pursuant to Judiciary Law §90(4) following his plea of guilty in the United States District Court for the Eastern District of New York to one count of conspiracy to possess with intent to distribute narcotics in violation of 21 USC §§ 846 and 841(b)(1)(B)(i)and(c)(211 AD2d 240).

Upon the papers submitted in support of the motion and the papers submitted in response thereto, it is

ORDERED that the motion is held in abeyance and the matter is referred to the Committee on Character and Fitness to investigate and report on the respondent's current fitness to be an attorney, including but not limited to his post-disbarment employment as a "paralegal" and "legal assistant," his financial obligations with respect to his ex-wife and daughter, and his tax returns covering the entire post-release period.
