| DECISION & ORDER ON MOTION |
Motion by the appellant to recall and vacate so much of a decision and order on motion of this court, entitled "In the Matter of the Dismissal of Causes for Failure to Perfect - July 2007 Calendar," dated August 13, 2007, as dismissed appeals from a judgment of the Supreme Court, Kings County, dated January 26, 2006, an order of the same court dated April 4, 2006, and a money judgment of the same court also dated April 4, 2006, pursuant to 22 NYCRR 670.8(e) for failure to timely perfect the same, to reinstate the appeals, to enlarge the time to perfect the appeals, to waive the filing fee, for free transcripts, and for the assignment of counsel.
Upon the papers filed in support of the motion and no papers having been filed in opposition or relation thereto, it is
ORDERED that the branches of the motion which are to recall and vacate so much of the decision and order on motion dated August 13, 2007, as dismissed the appeals, to reinstate the appeals, and to enlarge the time to perfect the appeals are granted; and it is further,
ORDERED that the so much of the decision and order on motion of this court dated August 13, 2007, as dismissed the instant appeals, is recalled and vacated; and it is further,
ORDERED that the appellant's time to perfect the appeals by causing the original papers constituting the record on the appeals to be filed in the office of the Clerk of this court (see 22 NYCRR 670.9[d][2]) and by serving and filing his brief on the appeals is enlarged until November 20, 2007; and it is further,
ORDERED that no further enlargements of time shall be granted; and it is further,
ORDERED that the branches of the motion which are to waive the filing fee, for free transcripts, and for the assignment of counsel are denied.
