| DECISION & ORDER ON MOTION |
Motion by the appellant on appeals from an order of the Supreme Court, Suffolk County, dated October 27, 2005, and a judgment of the same court entered December 12, 2005, which were determined in an opinion and order of this Court dated May 15, 2007, to amend the opinion and order to the extent of deleting the word "defendant" from the final decretal paragraph thereof and substituting the word "plaintiff."
Upon the papers filed in support of the motion and no papers having been filed in opposition thereto, it is
ORDERED that the motion is granted and the opinion and order dated May 15, 2007, is amended by deleting from the final decretal paragraph thereof the word "defendant" and substituting therefor the word "plaintiff."
