DECISION & ORDER ON MOTION FOR REINSTATEMENT

Motion by the respondent, Alan Zigman, for reinstatement as an attorney and counselor-at-law. By decision and order on motion of this court dated October 26, 2004, the respondent was immediately suspended from the practice of law, pursuant to Judiciary Law §90(4)(f), as a result of his conviction of a serious crime. The Grievance Committee for the Tenth Judicial District was authorized to institute and prosecute a disciplinary proceeding against him and the issues raised were referred to the Honorable Arthur W. Lonschein, as Special Referee, to hear and report. By opinion and order dated March 21, 2006, this court granted the Grievance Committee's motion to confirm the report of the Special Referee sustaining one charge of professional misconduct against the respondent and he was suspended from the practice of law for a period of one year, commencing immediately, with credit for the time already elapsed under the interim suspension imposed by order of this court dated October 26, 2004. By decision and order on motion of this court dated December 5, 2006, the respondent 's motion for reinstatement was held in abeyance and the matter was referred to the Committee on Character and Fitness to investigate and report on the respondent's current fitness to practice law, including but not limited to details of his compliance with the order of suspension and his prior voluntary closing of his practice. The respondent was admitted to the Bar at a term of the Appellate Division of the Supreme Court in the Second Judicial Department, March 24, 1993, under the name of Alan Scott Zigman.

Upon the report of the Committee on Character and Fitness and the exhibits annexed thereto, it is

ORDERED that the motion is granted; and it is further,

ORDERED that, effective immediately, the respondent Alan Zigman, admitted as Alan Scott Zigman, is reinstated as an attorney and counselor-at-law and the Clerk of the Court is directed to restore the name of Alan Scott Zigman to the roll of attorneys and counselors-at-law.
