Appeal by Antoine Shell from a judgment of the County Court, Dutchess County, rendered May 11, 2004. By order to show cause dated October 18, 2006, the appellant was directed to show cause before this Court why an order should or should not be made and entered dismissing the appeal as abandoned (see CPL 460.70[2][c]; 22 NYCRR 670.8[f]).
Upon the Court's own motion and no papers having been filed in response thereto, it is
ORDERED that the appeal is dismissed.
