| DECISION & ORDER ON MOTION |
Motion by the appellant on an appeal from an order of the Surrogate's Court, Nassau County, dated July 19, 2007, to stay his obligation to file an accounting by October 10, 2007, pending hearing and determination of the appeal. By order of this court, dated September 14, 2007, the appellant's obligation to file an accounting was stayed pending hearing and determination of the motion.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that the motion is denied; and it is further,
ORDERED that the appellant's time to file the accounting is extended until November 7, 2007.
