| DECISION & ORDER ON MOTION |
On the Court's own motion, it is
ORDERED that the decisions and orders on motions dated September 11, 2006, and March 13, 2007, respectively, in the above-entitled action are recalled and vacated and the following decision and order on motion is substituted therefor:
Motion by the appellant pro se for leave to serve and file a supplemental brief on an appeal from an order of the Supreme Court, Queens County, dated September 30, 2004. Separate motion by the appellant pro se to enlarge the time to serve and file the supplemental brief.
Upon the papers filed in support of the motions and the papers filed in relation thereto, it is
ORDERED that the motion for leave to serve and file a supplemental pro se brief is denied, with leave to renew upon the filing by appellant's assigned counsel of a new brief raising issues relating to the order dated September 30, 2004; and it is further,
ORDERED that the motion to enlarge the time to serve and file a supplemental brief is denied as academic.
