DECISION & ORDER ON MOTION

Motion by the respondent for leave to appeal to the Court of Appeals from a decision and order of this court dated July 24, 2007, which determined an appeal from an order of the Family Court, Orange County, dated May 9, 2006, and to stay enforcement of the decision and order of this court dated July 24, 2007, pending hearing and determination of the appeal to the Court of Appeals.

Upon the papers filed in support of the motion and the papers filed in opposition and relation thereto, it is

ORDERED that the motion is denied.
