It is Ordered that the motion for a continuation of the stay is granted pending the determination of the appeal, presently scheduled for the December 2007 term. In the event the appellant fails to tender accruing use and occupancy to the petitioner on each subsequent rental due date, the latter may move on five days' notice for an order vacating the stay.
