Motion by the appellant for leave to reargue his motion to recall and vacate so much of a decision and order on motion of this court dated May 31, 2007, as dismissed an appeal from a judgment of the Supreme Court, Kings County, dated August 10, 2005, and to reinstate the appeal, which was determined by decision and order on motion dated August 16, 2007.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that the motion is denied.
