DECISION & ORDER ON MOTION

Motion by Carl Bruce, Mount Carmel Baptist Church, Inc., Leroy Adams, Lloyd Bolling, Evans Goka, Wilvester Wright, James Bostic, Carol Blakney, Mark Williams, Alma Long, Thommy Thompson, Warren Fields, Josephine King-Peterson, Stanford Roache, John Talbert, and Napolean Mays, inter alia, for leave to appeal to this court from an order of the Supreme Court, Westchester County, dated September 12, 2007, and to stay enforcement of so much of the order as prohibited Carl Bruce from serving as pastor of the Mount Carmel Baptist Church, Inc., pending hearing and determination of the appeal.

Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is

ORDERED that the branches of the motion which are for leave to appeal and to stay enforcement of so much of the order as prohibited Carl Bruce from serving as pastor of the Mount Carmel Baptist Church, Inc., pending hearing and determination of the appeal are granted; and it is further,

ORDERED that so much of the order as prohibited Carl Bruce from serving as pastor of the Mount Carmel Baptist Church, Inc., is stayed pending hearing and determination of the appeal or hearing and determination of the petition of the respondents Pamela Thompson, Woella Gulliver, Florina Talbert, Ruth Guthrie, and Sarah Moore by the Supreme Court, Westchester County, whichever comes first; and it is further,

ORDERED that the motion is otherwise denied.
