Motion by the appellant for leave to reargue an appeal from a judgment of the Supreme Court, Queens County, rendered January 28, 2005, which was determined by decision and order of this court dated May 15, 2007.

Upon the papers filed in support of the motion and no papers having been filed in opposition or relation, it is

ORDERED that the motion is denied.

We note that the untimely affirmation in opposition submitted by the respondent has been rejected and was not considered in the determination of this motion.
