| DECISION & ORDER ON MOTION |
Appeal by Paul Woolery from a judgment of the Supreme Court, Kings County, rendered September 14, 2000. The court's records indicate that the appellant filed a motion for leave to proceed as a poor person and for the assignment of counsel in November 2001. The motion was never determined and the court is unable to locate the motion papers. By letter dated May 16, 2005, the appellant was requested to forward copies of his motion papers to the court. He never responded to that letter. By order to show cause dated March 30, 2007, the appellant was directed to show cause before this court, why an order should or should not be entered dismissing the appeal as abandoned.
Upon the court's own motion and no papers having been filed in response thereto, it is
ORDERED that the appeal is dismissed as abandoned.
