Administration for Chilldren's Services, respondent;

Donna C. (Anonymous), appellant.

(Proceeding No. 2)

(Docket Nos. N-09589-06, N-09590-06)

ORDER TO SHOW CAUSE

Appeal by Donna C. from a order of disposition of the Family Court, Queens County, dated July 25, 2007, a fact-finding order of the same court dated May 29, 2007, and a permanency hearing order of the same court dated July 25, 2007, both indicate that the appellant, Donna C., did not appear at either hearing.

Now, on the court's own motion, it is

ORDERED that the parties or their attorneys are directed to show cause before this court why an order should or should not be made and entered dismissing the above-entitled appeal on the ground that the order of disposition was entered upon the default of the appellant and no appeal lies from an order entered on the default of the appealing party (see CPLR 5511), by filing an affirmation or affidavit on that issue with the Clerk of this court on or before November 16, 2007; and it is further

ORDERED that the Clerk of this court, or his designee, is directed to serve a copy of this order to show cause on the parties or their attorneys by regular mail.

CRANE, J.P., GOLDSTEIN, FLORIO and DILLON, JJ., concur.
