| DECISION & ORDER ON MOTION |
Motion by the respondent on an appeal from an order of the Supreme Court, Kings County, dated May 9, 2007, in effect, to strike "Attachment I" to the appellant's reply brief and all references to "Attachment I," and for an award of costs.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that the branch of the motion which is, in effect, to strike "Attachment I" to the appellant's reply brief and all references to "Attachment I" is granted, the table of contents reference to "Attachment I," the end of the last sentence on page 11 beginning with the words "which reports" through the words "Attachment I," and "Attachment I" are stricken from the reply brief, and on or before November 13, 2007, the appellant shall delete or remove that material from the copies of the reply briefs filed with the Clerk of the Court; and it is further,
ORDERED that the motion is otherwise denied.
