It is Ordered that the motion is granted to the extent of adjourning the appeal to the February 2008 term. This is to afford the appellant an opportunity to submit the complete trial transcript to be settled before the trial court and then forwarded to the Clerk of the Appellate Term. The legal fees hearing is to be restored to the Civil Court calendar. In the event the completed transcript, along with a new Clerk's Return, is not submitted to this Court by December 11, 2007, the petitioner may move on five days' notice for an order vacating the stay.
