DECISION & ORDER ON MOTION

Motion by the petitioner in a proceeding pursuant to CPLR article 78 that was transferred to this court by an order of the Supreme Court, Nassau County, dated December 5, 2006, to enjoin the respondent from enforcing an order of suspension dated June 7, 2006, pending hearing and determination of the proceeding and to enlarge the time to perfect the proceeding.

Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is

ORDERED that the branch of the motion which is to enjoin the respondent from enforcing the order of suspension dated June 7, 2006, is denied; and it is further,

ORDERED that the branch of the motion which is to enlarge the time to perfect the proceeding is granted, the petitioner's time to perfect the proceeding is enlarged until December 20, 2007, and the petitioner's record or appendix and brief must be served and filed on or before that date; and it is further,

ORDERED that no further enlargement of time shall be granted.
