935 Eighth Ave., LLC v Griffin, David L.
It is Ordered that the motion for re-argument is granted. Upon reconsideration, the court adheres to the denial of the stay of the execution of the warrant of eviction. However, the re-renting of the premises is stayed through November 19, 2007. If, by said date, the appellant has tendered the arrears outstanding ($6,000.oo) to the landlord, without prejudice, then the appellant may seek a continuation of the stay of the re-renting pending the perfection of the appeal.
