Counsel for appellant having moved to dismiss the appeal taken from a judgment of the Supreme Court entered in the Office of the Clerk of the County of Onondaga on June 20, 2006, on the ground that appellant is now deceased,

Now, upon reading and filing the affirmation of Philip Rothschild, dated October 4, 2007, the notice of motion with proof of service thereof, the affirmation of James P. Maxwell, dated October 12, 2007, and due deliberation having been had thereon,

It is hereby ORDERED that the motion be and the same hereby is granted, and the appeal is dismissed.

Memorandum: Appeal unanimously dismissed and matter remitted to Supreme court to vacate the judgment of conviction and dismiss the indictment either sua sponte or on application of either the District Attorney or counsel for defendant (see People v Matteson, 75 NY2d 745).
